EMERGENCY ACCESS & FIRE LANE ORDINANCE

Section 1. Purpose 

The purpose of this ordinance is to ensure that emergency vehicles have safe and unobstructed access to all properties, structures, and public areas within the Town of Paleto Bay. Maintaining clear emergency access routes is essential to protecting life, property, and the efficient delivery of emergency services. 

Section 2. Definitions 

Emergency Access Route means any roadway, driveway, easement, alley, or other designated path intended for use by police, fire, emergency medical services, or other authorized emergency vehicles.

Fire Lane means a designated area where stopping, standing, or parking is prohibited in order to maintain unobstructed access for emergency responders.

Obstruction means any vehicle, trailer, dumpster, equipment, material, structure, vegetation, or object that impedes or restricts emergency access.

Emergency Vehicle means any vehicle operated by law enforcement, fire services, emergency medical services, or other government agencies engaged in official emergency duties.

Section 3. Establishment of Fire Lanes 

The Town may designate fire lanes at public buildings, schools, commercial properties, apartment complexes, healthcare facilities, government facilities, and other locations where emergency access is necessary.

Fire lanes shall be clearly marked with approved signage, curb markings, pavement striping, or other methods prescribed by the Town.

Property owners shall maintain all fire lane markings in a visible condition.

Section 4. Prohibited Parking and Stopping 

No person shall stop, stand, or park any vehicle in a designated fire lane except:

• Emergency vehicles actively engaged in official duties;

• Vehicles specifically authorized by emergency personnel;

• Temporary loading or unloading when directed by law enforcement or fire officials.

A violation exists regardless of whether the driver remains with the vehicle.

Section 5. Obstruction of Emergency Access 

No person shall block, obstruct, or interfere with any emergency access route by:

• Parking vehicles;

• Placing trailers or containers;

• Storing construction materials or equipment;

• Allowing vegetation to impede access;

• Installing gates or barriers without approved emergency access provisions;

• Depositing snow, debris, or other materials that reduce access.

Any obstruction creating an immediate hazard may be removed without prior notice.

Section 6. Private Property Requirements 

Owners of commercial, industrial, multi-family, and institutional properties shall maintain access roads and fire lanes sufficient to accommodate emergency apparatus.

Required access routes shall remain unobstructed at all times and shall not be used for storage or long-term parking.

Property owners may be required to install and maintain approved signage identifying designated fire lanes.

Section 7. Temporary Closures 

No person shall temporarily close or obstruct any emergency access route for construction, maintenance, events, or other activities without prior approval from the Town.

Approved closures shall provide an alternative route acceptable to emergency services.

Section 8. Special Events 

Permitted festivals, parades, markets, or community events shall maintain emergency access corridors as required by the event permit.

The Town may require designated emergency vehicle lanes, removable barricades, or on-site traffic control personnel.

Section 9. Gates and Security Devices 

Any gate restricting access to roads serving multiple structures or developments shall provide emergency responders with approved means of immediate entry.

Electronic gates shall include emergency override capability or approved access systems as determined by the Fire Chief.

Section 10. Snow and Vegetation 

Property owners shall remove snow, overgrown vegetation, or other natural obstructions that interfere with designated emergency access routes or fire hydrants.

Failure to do so after notice may result in corrective action by the Town, with associated costs assessed to the property owner.

Section 11. Towing Authority 

Any vehicle found in violation of this ordinance may be immediately removed and towed without prior notice whenever necessary to preserve emergency access.

The owner shall be responsible for all towing and storage costs in addition to any applicable fines.
