ILLEGAL DUMPING ORDINANCE

Section 1. Purpose 

The purpose of this ordinance is to prohibit the unlawful disposal of waste and debris within the Town of Paleto Bay, protect public health and safety, preserve the natural environment, maintain the appearance of the community, and prevent pollution of roads, waterways, and public lands.

The Town recognizes that illegal dumping creates environmental hazards, increases cleanup costs, attracts pests, and diminishes the quality of life for residents and visitors.

Section 2. Definitions 

Illegal Dumping means the disposal, deposit, placement, or abandonment of waste on public or private property without the permission of the property owner or in violation of applicable law.

Waste includes garbage, litter, refuse, household trash, furniture, appliances, tires, construction debris, hazardous materials, yard waste, abandoned vehicles or parts, electronics, and any discarded material intended for disposal.

Public Property means any street, alley, sidewalk, park, trail, right-of-way, drainage ditch, government facility, or land owned or maintained by the Town.

Responsible Party means any person who deposits, causes to be deposited, transports for disposal, or directs another person to illegally dump waste.

Section 3. Prohibited Conduct 

No person shall:

1. Dump or deposit waste on public property except in designated receptacles or authorized disposal facilities.

2. Dispose of waste on private property without the consent of the property owner.

3. Throw or abandon trash, debris, or refuse from any vehicle.

4. Deposit construction materials, landscaping debris, appliances, furniture, tires, or similar items along roadsides or vacant lots.

5. Leave waste in parks, trails, waterways, or recreational areas outside approved containers.

6. Place hazardous materials where they may contaminate soil or water.

The intent to retrieve discarded materials at a later time shall not exempt a person from this ordinance.

Section 4. Responsibility of Transporters 

Any person transporting waste shall ensure that all loads are properly secured to prevent materials from escaping onto public roadways.

Vehicles carrying loose materials shall be covered or otherwise secured to prevent spillage.

Failure to secure a load resulting in litter or debris constitutes a violation of this ordinance.

Section 5. Property Owner Responsibilities 

Property owners shall maintain their property free from accumulated illegally dumped waste when aware of its presence.

Victims of illegal dumping shall not be presumed responsible for the deposited materials solely because the waste is located on their property.

The Town may assist in identifying responsible parties whenever practical.

Section 6. Reporting and Investigation 

Residents are encouraged to report suspected illegal dumping to the Paleto Bay Police Department or Code Enforcement Office.

Investigations may include:

• Witness statements;

• Surveillance footage;

• Vehicle registration information;

• Documents or identifying materials found within discarded waste;

• Photographic evidence;

• Other lawful investigative methods.

Section 7. Removal of Waste 

When illegal dumping occurs on public property, the Town shall make reasonable efforts to remove the waste as resources permit.

When dumped materials present an immediate threat to health, safety, or the environment, emergency cleanup may be performed without delay.

Section 8. Cost Recovery 

The Town may seek reimbursement from the responsible party for:

• Cleanup expenses;

• Equipment costs;

• Personnel time;

• Disposal fees;

• Environmental remediation;

• Administrative expenses.

Such recovery may be pursued in addition to civil or criminal penalties.

Section 9. Hazardous Materials 

Any person who illegally disposes of hazardous substances, petroleum products, chemicals, batteries, medical waste, or similar dangerous materials may be subject to enhanced penalties and immediate emergency response measures.

Nothing in this ordinance limits prosecution under applicable environmental laws.

Section 10. Community Cleanup Events 

Nothing in this ordinance prohibits organized community cleanup events, roadside beautification projects, or authorized waste collection drives approved by the Town.

Participants shall properly dispose of collected materials at approved facilities.
